§ 1 Scope of Application

1. These General Terms and Conditions (hereinafter “AGB”;) apply to all contracts for the delivery of goods concluded by a consumer
(hereinafter "customer") with the seller (hereinafter “Calemi”) regarding the goods presented by Calemi in its online shop. 2. Deviation
from the customer’s general terms and conditions will not be recognized unless Calemi expressly agrees to their validity in writing.
3. Our online shop is exclusively directed at consumers. A consumer is any natural person who enters into a legal transaction for
purposes that predominantly do not fall within their commercial or self-employed professional activity.

§ 2 Conclusion of contract

1. The products contained in Calemi’s online shop do not constitute binding offers by Calemi but serve to submit a binding offer by
the customer.
2. The customer can select products from the seller’s range and collect them in a shopping cart by clicking the “Add to Cart” button. In
the shopping cart, the customer can view and modify the products at any time. By clicking the “Proceed to Checkout” button, the
customer submits a legally binding request to purchase the products in the shopping cart.
3. However, the request can only be submitted and transmitted if the customer, by clicking the “Accept Terms and Conditions”;
button, accepts these contract terms and thus includes them in their request.
4. Calemi can accept the customer’s offer within five days,
by sending the customer a written order confirmation (order confirmation by email), with the receipt of the order confirmation at
the customer being decisive, or
by delivering the ordered goods to the customer, with the receipt of the goods at the customer being decisive,
or by requesting payment from the customer after the customer has placed the order.
If several of the above alternatives exist, the contract is concluded at the time when one of the above alternatives occurs first. The period
for accepting the offer begins on the day after the offer is sent by the customer and ends with the expiry of the fifth day following the
sending of the offer.
5. If Calemi does not accept the customer’s offer within the aforementioned period, this shall be deemed a rejection of the offer with
the consequence that the customer is no longer bound by their declaration of intent.

§ 3 Contract Language, Contract Text Storage

The languages available for the conclusion of the contract are German and English. Calemi saves the contract text and sends the
order data and AGB to the customer in text form.

§ 4 Prices and Payment Conditions

1. The prices listed in the offer at the time of the order apply. The prices quoted are final prices, i.e., they include the respective
applicable German legal value-added tax.
2. In addition to the stated product prices, shipping costs (4,00€) will be incurred.
3. Any costs that may arise in individual cases and are not the responsibility of Calemi, such as costs of a money transaction or
import duties or taxes, are to be borne by the customer.
4. In principle, Calemi offers the payment methods of prepayment and Paypal. Calemi reserves the right not to offer certain payment
methods for each order and to refer to other payment methods.
5. If prepayment by bank transfer is agreed, payment is due upon conclusion of the contract.

§ 5 Terms of delivery and shipping

1. The delivery of the goods is made to the delivery address specified by the customer, unless otherwise
agreed. 2. All countries to which Calemi delivers can be viewed through this link.
3. If the delivery of the goods fails for reasons that the customer is responsible for, the customer bears the costs incurred by Calemi as a result.
4. Self-collection is not possible for logistical reasons.

§ 6 Right of withdrawal

1. Consumers generally have a right of withdrawal.

§ 7 Retention of title

If Calemi provides advance payment, Calemi reserves ownership of the delivered goods until the purchase price owed has been paid in
full.

§ 8 Warranty

If the purchased item is defective, the provisions of the statutory warranty apply.

§ 9 Liability

1. Liability for damages exists only in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the
proper execution of the contract and on the observance of which the contractual partner may regularly rely, whereby in these cases
the liability of Calemi is limited to the replacement of the foreseeable, typically occurring damage.
2. Otherwise, the liability of Calemi is excluded, unless there are mandatory legal provisions. The exclusion of liability does not apply
in cases of intent and gross negligence as well as in the event of culpable injury to life, body, and health.

§ 10 Data Protection

1. Calemi treats all data provided by customers confidentially.
2. For the proper processing of the contract, it is necessary to store and process personal data. This is done in accordance with the
relevant data protection regulations and the privacy policy, which can be found here, and the customer confirms their knowledge of
this by submitting a contract offer.

§ 11 Other Provisions

1. If one or more provisions of these AGB are or become ineffective, the remaining provisions remain unaffected. The parties undertake
to replace the ineffective provision with an effective one whose economic success comes as close as possible to the ineffective
regulation. This also applies in the event of a regulatory gap.
2. The business relationship between the parties is exclusively governed by German law, excluding the laws governing the international
sale of movable goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of
the law of the state in which the consumer has their habitual residence is not withdrawn (principle of favorability).

§ 12 Alternative Dispute Resolution

1. The European Commission provides a platform for online dispute resolution on the Internet, which can be accessed here. 2. This
platform serves as a point of contact for the out-of-court resolution of disputes arising from online purchase or service contracts in which
a consumer is involved. Calemi is neither obligated nor willing to participate in a dispute resolution procedure before a consumer
arbitration board as a seller.

Allgemeine Geschäftsbedingungen

§ 1 Geltungsbereich

1. Diese Allgemeinen Geschäftsbedingungen (nachfolgend “AGB”) gelten für alle Verträge über die Lieferung von Waren, die ein Verbraucher (nachfolgend „Kunde“) mit dem Verkäufer (nachfolgend „Calemi“) über den Onlineshop von Calemi abschließt.

2. Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, Calemi stimmt ihrer Geltung ausdrücklich schriftlich zu.

3. Der Onlineshop richtet sich ausschließlich an Verbraucher. Ein Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch selbständigen beruflichen Tätigkeit zugerechnet werden können.

§ 2 Vertragsschluss

1. Die im Onlineshop dargestellten Produkte stellen kein verbindliches Angebot von Calemi dar, sondern eine Einladung zur Abgabe eines verbindlichen Angebots durch den Kunden.

2. Der Kunde kann aus dem Sortiment Produkte auswählen und über den Button „In den Warenkorb“ in einem virtuellen Warenkorb sammeln. Im Warenkorb kann der Kunde jederzeit Änderungen vornehmen. Mit dem Klick auf „Zur Kasse“ gibt der Kunde ein verbindliches Angebot zum Kauf der im Warenkorb befindlichen Produkte ab.

3. Das Angebot kann nur übermittelt werden, wenn der Kunde durch das Setzen eines Hakens die AGB akzeptiert und somit Bestandteil seines Angebots macht.

4. Calemi kann das Angebot des Kunden innerhalb von fünf Tagen annehmen:
   – durch eine schriftliche Auftragsbestätigung per E-Mail (maßgeblich ist der Zugang beim Kunden),
   – durch Lieferung der Ware (maßgeblich ist der Zugang der Ware beim Kunden), oder
   – durch Zahlungsaufforderung nach Bestellung.
   Der Vertrag kommt in dem Moment zustande, in dem eine der genannten Optionen zuerst eintritt.

5. Nimmt Calemi das Angebot innerhalb der Frist nicht an, gilt dies als Ablehnung.

§ 3 Vertragssprache, Speicherung

Vertragssprachen sind Deutsch und Englisch. Der Vertragstext wird gespeichert und dem Kunden per E-Mail mit den Bestelldaten und AGB zugesandt.

§ 4 Preise und Zahlungsbedingungen

1. Es gelten die im Angebot zum Zeitpunkt der Bestellung angegebenen Preise. Diese verstehen sich als Endpreise inkl. gesetzlicher deutscher Umsatzsteuer.

2. Zusätzlich fallen Versandkosten in Höhe von 4,00 € an.

3. Weitere Kosten wie z. B. Bankgebühren oder Einfuhrabgaben trägt der Kunde.

4. Calemi bietet in der Regel die Zahlungsarten Vorkasse und PayPal an. Calemi behält sich das Recht vor, einzelne Zahlungsarten auszuschließen.

5. Bei Vorkasse ist der Betrag sofort nach Vertragsabschluss fällig.

§ 5 Liefer- und Versandbedingungen

1. Die Lieferung erfolgt an die vom Kunden angegebene Lieferadresse, sofern nichts anderes vereinbart wurde.

2. Die belieferten Länder sind über diesen Link einsehbar.

3. Sollte eine Zustellung aufgrund des Kunden scheitern, trägt der Kunde die dadurch entstandenen Kosten.

4. Eine Selbstabholung ist aus logistischen Gründen nicht möglich.

§ 6 Widerrufsrecht

1. Verbrauchern steht grundsätzlich ein Widerrufsrecht zu.

2. Näheres dazu findet sich in der Widerrufsbelehrung von Calemi.

§ 7 Eigentumsvorbehalt

Bis zur vollständigen Bezahlung bleibt die Ware Eigentum von Calemi.

§ 8 Gewährleistung

Es gelten die gesetzlichen Gewährleistungsrechte bei Mängeln der Ware.

§ 9 Haftung

1. Calemi haftet nur bei Verletzung wesentlicher Vertragspflichten, deren Erfüllung für die ordnungsgemäße Durchführung des Vertrags notwendig ist. Die Haftung ist auf den vorhersehbaren, typischerweise eintretenden Schaden begrenzt.

2. Im Übrigen ist die Haftung ausgeschlossen, außer in Fällen von Vorsatz, grober Fahrlässigkeit oder bei Verletzung von Leben, Körper oder Gesundheit.

§ 10 Datenschutz

1. Calemi behandelt sämtliche Kundendaten vertraulich.

2. Zur Vertragsabwicklung ist die Speicherung und Verarbeitung personenbezogener Daten erforderlich. Dies erfolgt gemäß den geltenden Datenschutzbestimmungen und der Datenschutzerklärung, der der Kunde durch seine Bestellung zustimmt.

§ 11 Schlussbestimmungen

1. Sollten einzelne Klauseln dieser AGB unwirksam sein, bleibt der Vertrag im Übrigen wirksam. Die Parteien verpflichten sich, eine wirtschaftlich möglichst gleichwertige Regelung zu finden.

2. Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Für Verbraucher gilt dies nur, sofern dadurch nicht zwingende Schutzvorschriften ihres Wohnsitzlandes entfallen.

§ 12 Streitbeilegung

1. Die EU-Kommission stellt eine Plattform zur Online-Streitbeilegung bereit: Online-Streitbeilegung

2. Calemi ist weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
